Limited Warranty Policy

1. General Warranty Statement

WINGOMART (“we,” “us,” or “our”) warrants that all products sold under the WINGOMART brand are free from defects in materials and workmanship for a period of one (1) year from the date of original purchase by the first end-user customer (“Warranty Period”). This Limited Warranty is extended exclusively to the original purchaser holding a valid proof of purchase in the form of the original invoice and is not transferable.

This Limited Warranty provides remedies solely as specified herein and is subject to the terms, limitations, and exclusions described below. By purchasing and using any WINGOMART product, you acknowledge and agree to be bound by this Warranty Policy.

 


 

2. Scope of Coverage

This Limited Warranty applies exclusively to manufacturing defects in materials and workmanship. For purposes of this Policy, a “defect” shall mean a flaw in the product that renders it unfit for its intended use when operated under normal conditions and in accordance with the product instructions.

WINGOMART reserves the right, at its sole discretion, to repair or replace any product or component found to be defective during the Warranty Period. In cases where the original product is no longer available, WINGOMART may replace the item with a product of equal or comparable value, functionality, or specification.

 


 

3. Exclusions from Warranty Coverage

This Limited Warranty does not cover, and WINGOMART shall bear no responsibility for, any of the following:

  • Physical damage of any kind, whether caused by accident, negligence, improper handling, transportation, or misuse.

  • Normal wear and tear consistent with ordinary use, including but not limited to scratches, abrasions, fading, or deterioration of materials over time.

  • Damage resulting from improper installation, repair, or maintenance, whether performed by the purchaser or an unauthorized third party.

  • Alteration or modification of the product, including but not limited to changes in design, structure, or function.

  • Commercial use, rental use, or resale of the product beyond ordinary consumer use.

  • Losses, damages, or expenses incidental to the use of the product, including without limitation any claims for inconvenience, loss of time, or consequential damages.

No warranty shall apply in the event the product serial number, identification tag, or other means of identification has been altered, removed, or defaced.

 


 

4. Warranty Claims Process

To obtain warranty service, the original purchaser must:

  1. Contact WINGOMART Customer Support via email at info@wingomart.com or contactus@wingomart.com, or through our live chat system. Customers will be required to provide the original invoice and a detailed description of the alleged defect.

  2. Upon receipt of the claim, WINGOMART will provide written instructions for proceeding with the return or inspection, including the return address of an authorized warehouse, if applicable.

  3. Customers may choose to:

    • Ship the product to a designated WINGOMART warehouse for inspection and service; or

    • Where available, arrange to drop off the product at one of WINGOMART’s authorized facilities.

  4. Shipping Costs: The customer shall bear the cost of shipping the product to WINGOMART or its designated facility. WINGOMART may, at its sole discretion, offer a discounted shipping rate for warranty returns.

  5. Upon receipt, WINGOMART will inspect the product. If the claim is determined to be valid, WINGOMART shall repair or replace the defective product or component at no charge for parts or labor. If the claim is denied, the customer will be notified and provided with options for return or disposal at their expense.

 


 

5. Remedies and Limitations

This Limited Warranty constitutes the sole and exclusive remedy available to the customer. WINGOMART’s obligation is strictly limited to the repair or replacement of defective products as set forth herein. Under no circumstances shall WINGOMART be liable for:

  • Any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of use, or inconvenience;

  • Any punitive damages or exemplary relief; or

  • Any expenses incurred by the customer in connection with removal, reinstallation, or transportation of the product, other than as expressly stated above.

To the fullest extent permitted by applicable law, any warranties that may otherwise be implied by law, including but not limited to warranties of merchantability or fitness for a particular purpose, are hereby excluded. Where such exclusions are prohibited by law, any implied warranty shall be limited to the duration of the Warranty Period.

 


 

6. Governing Law

This Warranty Policy shall be governed by and construed in accordance with the laws of Canada, Province of Quebec, City of Montréal (Ville Mont-Royal), without regard to its conflict of law provisions.
